Phase III Construction LLC — Initial Homeowner Agreement

THIS AGREEMENT IS VALID ONLY IF YOUR CLAIM IS APPROVED AND FUNDED ADEQUATELY BY YOUR INSURANCE COMPANY.

At Phase III Construction LLC, we understand that filing an insurance claim after a disaster is one of the most stressful experiences a homeowner can face. As a Michigan-licensed General Contractor and insurance restoration specialist, we stand beside our clients as advocates — making sure your property is fully restored and your claim reflects the true scope of every documented loss.

Our team prepares a comprehensive damage assessment using Xactimate estimating software and EagleView aerial measurement — the same industry-standard tools used by all major insurance carriers — so that your claim is built on an accurate, defensible foundation. When discrepancies exist between our findings and your carrier's initial estimate, we pursue resolution through documented evidence, photographic proof, and persistent advocacy. Our goal is simple: a full and fair outcome for you.

By signing below, you authorize Phase III Construction LLC (GC License #262000615) to make any temporary repairs necessary to mitigate further damages — billed to and paid for by your insurance company — and to evaluate the damage estimate produced by your insurance company for accuracy, completeness, and full scope recovery.

Terms & Conditions

This Agreement does not obligate the Homeowner or Phase III Construction LLC in any way unless the work is approved and funded adequately by your insurance company and accepted by Phase III Construction LLC. By signing, you authorize Phase III to begin all approved work approximately ten (10) working days after final settlement acceptance, including all required supplements.

Exclusivity: Homeowner agrees not to engage any other contractor to perform work related to this insurance claim without Phase III Construction LLC's prior written consent.

Except by written release from Phase III Construction LLC, the policyholder may not cancel this Agreement once the insurance company has approved the claim. All approved insurance proceeds — including supplements, overhead and profit, and code-required upgrades — shall constitute the agreed contract amount.

Claims Advocacy Fee: If the policyholder chooses not to proceed with repairs through Phase III Construction LLC after the claim has been approved and funded — for any reason — the policyholder agrees to pay Phase III Construction LLC 25% of the total gross insurance proceeds approved on this claim, as a Claims Advocacy Fee for services rendered in damage documentation, scope preparation, EagleView measurement, Xactimate estimating, and insurance negotiation. This provision survives cancellation of this Agreement.

The policyholder signing below directs their insurance company to furnish Phase III Construction LLC with a copy of the written damage estimate (Scope of Loss) and to communicate freely with Phase III Construction LLC on all matters and funding associated with this claim.

Electronic Signature Notice: By typing your full name and submitting this form, you agree that your electronic signature is legally binding under the Electronic Signatures in Global and National Commerce Act (E-SIGN), 15 U.S.C. § 7001, and the Michigan Uniform Electronic Transactions Act (UETA), MCL 450.831 et seq. Your typed name constitutes your legally enforceable electronic signature.
